What can the banks do?
When you take out a mortgage you are borrowing the amount on the guarantee that you will pay an amount back each month, if you breach these terms then the bank has the right to sell your property so as to pay back the total amount of the loan. Banks will only repossess your home as a last resort. Once you have fallen into arrears your lender will need to know how you are going to catch up the payments, if you don’t have a reasonable answer, the lender will usually write you a letter to say the case has been referred to a solicitor. Once the solicitors are involved they will send you a letter giving you seven days to rectify the arrears situation or as a minimum a proposal would be needed to say how you will catch up the payments. Based on this the solicitor can if not satisfied with your response, start court action without any further warning. They will then apply to the court for a repossession order. The decision to pursue a repossession order remains the right of your lender. The County Court will weigh up your position versus the lenders and decide whether or not a repossession order should be granted. The court will issue a summons, based on the solicitors demands, the summons will set a date for the hearing. At this stage it is wise to seek advice from a professional and to reply to the court .Your options will be dependant on the reasons why you have been threatened with repossession. A legal adviser can explain your options and whether the court is likely to allow you to stay in your home.
